Appeal by defendant City of New York from the order of June 25, 2004 deemed to be from the order entered January 30, 2004 insofar as it granted plaintiffs motion for summary judgment on its Labor Law § 240(1) claim, and, so considered, said order affirmed, with $10 costs.
